The petitioner seeks bail in a case registered for offences under Sections 272 and 273 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise (Amendment) Act, 2016.

It is contended that, as per allegation, 48.750 litres of foreign liquor was recovered from the ambassador car which was being driven by the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 14.09.2017. Considering the facts and the circumstances of the

No.52445 of 2017(2) dt.09-11-2017 2/2 case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Gaya in connection with Khijarsarai (Gaya) P.S. Case No. 254 of 2017 with a condition that one of the bailors of the petitioner(s) must be the close relative or his family member, who will file affidavit before the court below giving full genealogy showing his or her relationship with the petitioner and the other bailor shall be the resident of Bihar since the petitioner belongs to Jharkhand. Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds.
