This is an application for regular bail in connection with S.T. No. 778 of 2017 arising out of Sanokhar P.S. Case no. 30 of 2017 registered for the offences punishable under Sections 302, 120B r/w 34 of the Indian Penal Code.

Petitioner has been named in the FIR on the basis of suspicion only. Allegation against petitioner is committing murder of son of informant in conspiracy with other co-accused. It has further been submitted that similarly situated co-accused has already been granted bail in Cr. Misc. No. 46482 of 2017 by a Bench of this Court and case of petitioner stands on similar footing to that of co-accused. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, let

Patna High Court Cr.Misc. No.49607 of 2017(3) dt.12-12-2017 2/2 above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned 5th Addl. Sessions Judge, Bhagalpur, in connection with S.T. No. 778 of 2017 arising out of Sanokhar P.S. Case no. 30 of 2017. (S. Kumar, J) sudip/- U T
