1. Heard learned Counsel for the parties concerned.

The contention of the petitioner is that on the basis of his fake signature, a First Information Report has been lodged by somebody/unknown person for an occurrence, which took place on 07.03.2021, which was registered as Hisua Police Station Case No. 116 of 2021, fior the offences punishable under Sections 341/323/338/379/ 504/34 of the Indian Penal Code against four named

Patna High Court CR. WJC No.18 of 2022(4) dt.28-08-2023 2/3 accused persons.

3. Learned Counsel for the petitioner submits that one of the accused persons in the said First Information Report, namely, Pramod Kumar, who is the chowkidar, was instrumental in lodging the First Information Report by forging the signature of the petitioner.

Learned Counsel for the State submits that the petitioner has submitted a representation before the Superintendent of Police, Nawada, in which he has narrated the occurrence and has disclosed the name of the same set of accused persons against whom, the First Information Report, in question, was lodged. The only improvement which the petitioner wants, by alleging his forged signature on the First Information Report, is the use of specific weapon in course of commission of crime by the accused persons, whose names are mentioned in the First Information Report, in question. He further submits that the petitioner has already filed a protest petition in this regard before the learned Chief Judicial Magistrate, Nawada.

5. Regards being had to the nature of dispute and the fact that the petitioner has already filed an application before

Patna High Court CR. WJC No.18 of 2022(4) dt.28-08-2023 3/3 the Superintendent of Police, Nawada and a protest petition has also been filed before the learned Chief Judicial Magistrate, Nawada, I do not find any merit in this application.
