The petitioner seeks bail in Desari P.S. Case No. 147 of 2021, registered for the offence punishable under Sections 406, 379 and 34 of the Indian Penal Code.

As per the prosecution case, this petitioner along with his friend Dharmendra Paswan have stolen tempo of the informant.

It is submitted on behalf of the petitioner that alleged occurrence took place on 17.03.2021, but the FIR was lodged on 16.04.2021 after delay of one month without any plausible explanation. Co-accused Dharmendra Paswan has been granted bail by the court below itself. Petitioner claims clean antecedent and he is in custody since 17.04.2021.

Considering the facts and circumstances of the case,

Patna High Court CR. MISC. No.72190 of 2021(2) dt.10-03-2022 2/2 the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XV, Vaishali at Hajipur in connection with Desari P.S.
