The petitioners seek pre-arrest bail in connection with Complaint Case No.32 of 2017 in which cognizance has been taken for the offence punishable under Section 498A of the Indian Penal Code.

Considering the nature of allegation and the defence pleaded in the application preferred by the petitioners as also the submission that the petitioners were granted provisional bail by the court below initially after considering their prayer for

No.69037 of 2019(5) dt.05-03-2020 2/2 pre-arrest bail and they never misused the privilege of provisional bail, but later on their application was dismissed, in the event of arrest or surrender in the court below, they are directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Gaya in connection with Complaint Case No.32 of 2017 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
