JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-08-2022 The learned counsel for the petitioners is directed to remove all the defects pointed out by the Stamp Reporter within one month. He is also directed to make necessary corrections in the bail petition wherever it is necessary. Heard the learned counsel for the petitioners and learned APP for the State.

No.1269 of 2022(2) dt.03-08-2022 2/3 The petitioners apprehend their arrest for the offences alleged under Section 147, 148, 149, 341, 447, 323, 324, 325, 307, 448, 380, 427, 504 and 506 of the Indian Penal Code, registered in connection with Katra P.S.Case No. 158 of 2021.

As per allegation, 18 named accused persons came to the house of the informant and they badly assaulted the informant and his family members.

The learned counsel for the petitioners has submitted that members of the prosecution side had badly assaulted the members of the defense side and one Dinesh Thakur died during the course of treatment. His wife Neelam Devi was also badly injured and in this respect P.S.Case No. 159 of 2021 was registered in the same police station. He has submitted further that only to save their skin from that case, the informant has lodged the present case. He has also submitted that petitioners are persons of clean antecedent.

Considering the above facts and circumstances as well as the clean antecedents of the petitioners, let them abovenamed, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten

No.1269 of 2022(2) dt.03-08-2022 3/3 thousand) each, with two sureties of the like amount each to the satisfaction of Ms. Arti Kumari, Judicial Magistrate 1st Class, Muzaffarpur in connection with Katra P.S.Case No. 158 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
