The petitioner apprehends his arrest in a case registered for the offence punishable under Sections 467, 468, 420, 471, 422 of the Indian Penal Code.

Informant who is Postmaster has alleged that he had given his Punjab National Bank Account passbook to one Sharwan Kumar and who in collusion with Bank staff got transferred rupees five lakhs to his daughter's account. It has further been alleged that said Sharwan Kumar withdrew rupees five lakhs sixty one thousand through ATM of his daughter in collusion with bank staff.

It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case

Patna High Court CR. MISC. No.56788 of 2019(3) dt.20-11-2019 2/2 merely on suspicion as being an employee of the Bank where the account of informant and his daughter were opened. It has further been submitted that petitioner is merely a Clerk and he was neither a passing authority of cheque nor was he concern with operation of ATM card. Petitioner is an ex-serviceman of Indian Army and after completion of 26 years service in Indian Army, he joined the bank service in 2012 having a clean antecedent.

Considering the aforesaid facts and circumstances of the case, the provisional anticipatory bail granted to the petitioner vide order dated 06.09.2019 is hereby confirmed with similar terms and conditions.
