2. The petitioner apprehends arrest in connection with Forbesganj P.S. Case No. 212 of 2025 dated 02.05.2025, registered for the offence punishable under Sections 329(3), 126(2), 115(2), 76, 118(1), 303(2), 352, 351 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. The allegation against the petitioner is that he assaulted by means of Dabiya on the head of the son of the informant, namely, Md. Arsad Raza.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is submitted that the allegation against the petitioner doesn't corroborate with the injury report. The doctor has

Patna High Court CR. MISC. No. 65767 of 2025(2) dt.17-09-2025 2/2 opined that the injury is caused by hard and blunt substance. The nature of injury mentioned is grievous with regard to injury no. 1 and injury no. 2 is said to be simple in nature. It is further submitted that the F.I.R. has been lodged after four days of the occurrence. Lastly, it has been submitted that he has no criminal antecedent.

5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

6. Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest / surrender of the petitioner within a period of six weeks from today, in connection with Forbesganj P.S. Case No. 212 of 2025, he shall be released on anticipatory bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria, subject to condition as laid down under Section 482(2) of B.N.S.S.
