ANJANA MISHRA ORAL ORDER 15-11-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody since 24.08.2017 in connection with a case registered for the offences punishable under Sections 414/34/420/ of the Indian Penal Code and later on Sections 467/468 of the Indian Penal Code has been added. Learned counsel for the petitioner submits that admittedly the recovery of motorcycle was not made from the conscious possession of the petitioner. It is alleged that the person who has been apprehended the with the motorcycle has taken the name of the petitioner before the police, therefore, he is facing prosecution.

Considering the fact and circumstances and that there is no recovery from the conscious possession of the petitioner, let

Case No. 210/2017.
