ANJANA MISHRA ORAL ORDER 12-04-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners apprehended their arrest in connection with Amdabad P.S. Case No. 94/2015 registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

The case diary in the present case was called for, which has been received.

The learned counsel for the petitioners submits that during course of investigation, it has come in the case diary that the case against these petitioners was untrue and charge sheet has also been submitted under Section 304(A) of the Indian Penal

Patna High Court Cr.Misc. No.472 of 2016 (3) dt.12-04-2016 Code and not under Section 302 of the Indian Penal Code. Considering the nature of allegation made and that the other co-accused persons have already been extended the privilege of anticipatory bail in Cr. Misc. No. 50700 of 2015 vide order dated 29.03.2016 and also because these petitioners have no criminal antecedent, let the petitioners above named, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of Sri B.K.Choudhary, Judicial Magistrate 1st Class, Katihar in connection with Amdabad P.S. Case No. 94/2015 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
