Heard the learned counsel for the petitioner and learned APP for the State.

This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, registered in connection with Bakhari P.S.Case No. 154 of 2021.

The police got an information that the petitioner and his associate Pankaj Mahto were concealing country-made liquor and they were trying to sell the same. On raid, co-accused Pankaj Mahto was arrested and 15 litres of liquor was

The learned counsel for the petitioner has submitted that the petitioner was not arrested at the spot. Nothing was recovered from his possession, rather his name has figured in the confessional statement of co-accused Pankaj Mahto. Considering the above facts and circumstances as well as the period of detention of the petitioner since 01.11.2021, let the petitioner above-named be released on bail after framing of charge on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Begusarai in connection with Bakhari P.S.Case No. 154 of 2021.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
