JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State. No one appeared on behalf of O.P. No.2. The petitioner apprehends his arrest in connection with Compliant Case No. 3388 of 2015, registered under Sections 498(A), 379/34 of the Indian Penal Code and Section 3/4 of Dowry Prohibition Act.
Learned counsel for the petitioner submits that the matter was referred to the Mediation Centre, Patna High Court for settlement of the dispute between the petitioner and O.P.No.2. On the prayer of their counsels. The matter was settled between the parties on 23.06.2017. Accordingly, the petitioner fixed Rs. 38,000/- in the name of O.P. No.2 and gave Rs. 1,30,000/- in cash to her. The Mediator's Report dated 28.06.2017 and agreement
Patna High Court Cr.Misc. No.2543 of 2017 (5) dt.01-07-2017 2/2 entered in between the petitioner and O.P.No.2 disclosed that the dispute between the parties has been settled. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 2nd Class, Vaishali at Hajipur in connection with Compliant Case No. 3388 of 2015 (Trial No. 1644 of 2016), subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
