This application is for grant of anticipatory bail in connection with S. Tr. No.203 of 2015 arising out of Lakhisarai P.S.Case No.362 of 2015 for the offence under Sections 302, 34 and 498 of the Indian Penal Code.

It is submitted on behalf of the petitioner that there are allegation against the petitioner of firing on the father of the informant, due to which he died. The petitioner has remained in custody for about more than 1 1⁄2 years. The charge has been framed in this case but up-till-now, no positive progress has been made in the trial.

Having heard both sides. Considering the fact that the

No.831 of 2017 (2) dt.02-02-2017 petitioner has remained in custody for about 1 1⁄2 years and in this case, charge has been framed, the learned court below is directed to expedite the trial and conduct the same on day-to-day basis and try to conclude the trial within a period of nine months and if not concluded, the petitioner is at liberty to renew his prayer for bail.. The S.P., Lakhisarai is also directed to produce the remaining witnesses in the court on day-to-day basis without any failure.

Let a copy of this order be sent to the Sessions Judge, Lakhisarai and to the Sr. S.P., Lakhisarai also. With the aforesaid observation, this application is dismissed.
