Petitioners apprehend arrest in connection with Baheri P.S. Case No. 182 of 2022 registered for the offence under sections 143, 341, 323, 324, 379, 436, 504,34 of the Indian Penal Code.
Learned counsel for the petitioners submits that petitioner has not committed any offence as alleged in the first information report and he has been falsely implicated in this case. Moreover, similarly situated co-accused persons have been granted bail by different co-ordinate Benches of this Court vide orders dated 17.01.2023 and 27.03.2023 passed in Cr. Misc.
Patna High Court CR. MISC. No.62499 of 2022(2) dt.17-04-2023 2/2 Nos. 53453 of 2022 and 1264 of 2023 respectively. Petitioners have no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioners, above named, are directed to be released on bail on furnishing personal bond to the satisfaction of Additional Chief Judicial Magistate VII, Darbhanga in connection with Baheri P.S. Case No. 182 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure. (Arvind Srivastava, J) mcv/- U T
