JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-12-2023 The present writ petition has been filed seeking the following relief:- "That the petitioner above named prays before this Hon'ble Court to issue a writ in the nature of CERTIORARI / MANDAMUS or any other appropriate writ or order or direction for commanding the respondents to quash the Notification bearing no.4311 dated 24.7.2023 [Ann-1] where by the petitioner has been transferred and Further prayer to post the petitioner on the vacant and sanctioned post of

Patna High Court CWJC No.14045 of 2023(2) dt.11-12-2023 2/2 Chief Engineer at Patna as the Petitioner is going to retire on superannuation on dated 31.12.2023. Further prayer to consider the representation dated 9.8.2023 and 23.8.2023 [Ann-7 & 7/1] of the petitioner for posting as per the policy of the State Govt. contained in notification no. 3918 dated 25.10.1980 [Ann-8]."

At the outset, the learned counsel for the parties are in agreement that since the petitioner has now been transferred and posted as the Chief-Engineer, Urban Development and Housing Department, Government of Bihar, Patna, most of his grievances have stood redressed, nonetheless, the learned counsel for the petitioner submits that the petitioner has not been paid salary for a period of four months i.e. the period during which he was kept waiting for posting, hence the respondents be directed to take a decision with regard to the same, expeditiously, preferably within a period of two weeks from today. It is directed, accordingly.
