This application is for grant of bail in connection with Danapur P.S.Case No.620 of 2013, G.R.No.3610 of 2013 for the offence under Sections 147, 148, 149, 302 of the Indian Penal Code and 27 of the Arms Act.

It is submitted on behalf of the petitioner that in this case other co-accused persons have been granted bail but the petitioner is in custody for more than three years and there is no progress in the trial. However, it is admitted by the learned counsel for the petitioner that earlier the bail application had been rejected by this Court, vide order dated 19.12.2014 passed in Cr. Misc. No.50610 of 2014, however the other co-accused have been granted bail, as such he has moved for grant of bail.

Having heard both sides. In view of the fact that earlier an application was filed by the petitioner for grant of bail, which was rejected by this Court, I am not inclined to grant bail to the petitioner at this stage, however, as the petitioner is in custody for more than three years, as submitted by the learned counsel for the petitioner, the learned trial court is directed to expedite the trial and try to conclude it within a period of nine months and the Sr. S.P., Patna is also directed to make the witnesses available in the case on each date fixed.

With the aforesaid observation, this application is dismissed.
