Two live cartridges are said to have been recovered from conscious possession of the petitioner, for which, petitioner is languishing in jail custody since 02-01-2015. Although it is stated in the first information report that petitioner and his associates were caught by the villagers, when they were fleeing after committing the loot of a motorcycle but seizure list does not reflect this fact that any motorcycle has been recovered from conscious possession of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner named above, be released on bail on furnishing bail bonds of Rs. 10,000/-

Patna High Court Cr.Misc. No.1860 of 2016 (2) dt.25-01-2016 2/2 (ten thousand) with two sureties of the like amount each in connection with Mohammadpur P.S. Case No. 01 of 2015 to the satisfaction of learned Chief Judicial Magistrate, Gopalganj. (Hemant Kumar Srivastava, J) A.K.V./- U T
