1. Heard learned counsel for the petitioner and learned APP for the State.

2. This is the second attempt of the petitioner to seek bail as earlier, his bail application was rejected by order dated 30.03.2022 in Cr. Misc. No.45629 of 2021 on the ground that he is alleged to be the main assailant. It is further submitted that no doubt, trial has commenced and out of 14 witnesses, only 04 witnesses till date has been examined and the petitioner is in custody since 06.09.2020.

3. Since the trial has commenced and witnesses have been examined and petitioner is alleged to be the main assailant, the Court is not inclined to release the petitioner on bail.

4. Accordingly, the prayer for bail of the petitioner

Patna High Court CR. MISC. No.62664 of 2023(2) dt.15-09-2023 2/2 stands rejected.

5. However, the trial Court is directed to expedite the trial.
