====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 18-10-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner has preferred this application for grant of regular bail in connection with Mahua P.S. Case No. `180 of 2015 dated 13.04.2015 registered for the offence punishable under Sections 414 of the I.P.C., 17 of C.L.A. Act and Sections 25(1-b)a, 26 and 35 of the Arms Act.
3. As per the prosecution case, on getting information, the informant apprehended one co-accused Dinesh Singh Chandrabansi and two persons fled away from the place of occurrence. From the possession of the co-accused Dinesh Singh Chandrabansi, two country made pistols, two country made guns, one country made rifle, one iron Dabiya (sharp
Patna High Court CR. MISC. No.67651 of 2023(2) dt.18-10-2023 2/3 edged weapon), four live cartridges, two posters, one mobile and Motorcycle were recovered and he also disclosed the name of the petitioner as Ravindra Sahni and the other co-accused persons.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has six criminal antecedents and in five cases, he is on bail, as stated in paragraph no. 3 of the bail petition. The name of the petitioner has sprang up in the present case on the basis of the confessional statement of the coaccused, Dinesh Singh Chandrabansi. Nothing incriminating article has been recovered from the possession of the petitioner. He is in custody in this case since 18.10.2022.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court concerned, Vaishali at Hajipur, in connection with Mahua P.S. Case No. 180 of 2015 with the condition:-

No.67651 of 2023(2) dt.18-10-2023 3/3 (I) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
