The petitioner seeks bail in a case registered for offences under Section 120(B) of the Indian Penal Code and Section 30 (A) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 1820 litres of country made liquor was recovered from the pickup van which was being driven by the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 22.08.2017.

No.53350 of 2017(2) dt.09-11-2017 2/2 Considering the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise, Patna in connection with Fatuha P.S. Case No. 361 of 2017 with a condition that one of the bailors of the petitioner must be the close relative or his family member, who will file affidavit before the court below giving full genealogy showing his or her relationship with the petitioner and the other bailor of the petitioner will be the resident of Bihar since the petitioner belongs to Jharkhand.

Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds. (Dr. Ravi Ranjan, J) Vikash/- U T
