Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Jaynagar P.S. Case No. 234 of 2022 lodged under Sections 399, 402 of the I.P.C. read with Sections 25(1-b)a/ 26/ 35 of the Arms Act.

As per the prosecution case, there were 10 named persons have been made accused in this case. This F.I.R. is in 2 parts. In first part, some of the accused persons have been arrested and upon their disclosure that they are in possession of the arms which they have taken from the petitioner, the name of petitioner have figured in this case.

No.62878 of 2022(2) dt.22-02-2023 2/2 Learned counsel for the petitioner submits that the recovery of 3 live cartridges and 4 mobiles have been made from the possession of the petitioner. Counsel submits that petitioner is a student and details are described in Annexure-2. He is having clean antecedent and he is in custody since 22.07.2022.

Learned counsel for the State opposes the prayer for bail and submits that petitioner appears to be the arms supplier. In the present facts and circumstances of this case and the submissions made above, I am not inclined to grant bail to the petitioner at present but liberty is hereby granted that he may renew his prayer for bail after framing of charge. With this observation, the bail application stands rejected.
