JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-11-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Learned counsel for the petitioner submits that the petitioner has come to the Court for provisional bail on the ground that he has to undergo to Cardiac operation and in support of his contention, Annexure-4 is annexed herewith.

This petition for bail was earlier rejected by this Court by order dated 03.04.2017 in Cr. Misc. No. 9885 of 2017, as Annexure-1 with direction to expedite the trial and conclude the same within a period of one year from the receipt/production of a copy of this order.

Learned A.P.P. also opposes the prayer for bail.

No.54158 of 2017 (3) dt.22-11-2017 2/2 Having heard both sides and in view of the facts and circumstances as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- with two sureties of the like amount each to the satisfaction of learned VIITH Additional District Judge, Nalanda at Biharsharif in connection with Sessions Trial No. 334 of 2017 arising out of Rahui (Bhaganbigha) P.S.Case No. 256 of 2016, subject to the conditions that one of the bailors of the petitioner shall be a local person and further condition that further twenty days is allowed to the petitioner for his surrender in the learned Court below and on the event of failure on his part to appear before the Court below on given dates without showing any genuine reason, his bail bond shall be cancelled.
