Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Allegation in the FIR is that the petitioner and others assaulted to the son of the informant, as a result whereof, he died. Petitioner is in custody since 26.12.2015. The report of the learned Trial Judge would reveal that the record is running for prosecution evidence. However, no prosecution witness has turned up till date and the next date is fixed on 20.03.2018.

Considering the nature of allegation and the period already undergone by the petitioner, let the petitioner,

Patna High Court Cr.Misc. No.61703 of 2017 (4) dt.17-02-2018 above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Sessions Trial No.172 of 2016 arising out of Sasaram (Model) Police Station Case No.1449 of 2015, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
