JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2020 This application, for grant of anticipatory bail, arises out of Sandesh P.S. Case No. 120 of 2019, disclosing offences under Sections 147, 148, 149, 341, 307 of the Indian Penal Code.

Allegation against the petitioner is of firing on the informant causing injury to him.

Submission of learned counsel for the petitioner is that the occurrence is of 08.06.2019 and till 12.06.2019, nobody was named as assailant. However, later on petitioner has been attributed the allegation that he fired on the informant, which is false and concocted. Further submission is that he is Government teacher and there is no chance of his absconding. Learned counsel for the State opposed the prayer for anticipatory bail on the ground that there is direct allegation

Patna High Court CR. MISC. No.62018 of 2019(3) dt.08-01-2020 2/2 against the petitioner of firing on the informant. Having heard both sides, considering the facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner has to surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
