JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-06-2023 The present petition has been filed seeking the following relief :- "(i) For issuance of appropriate writ including a writ in the nature of mandamus directing and commanding respondents to forthwith sanction and pay the exgratia amount payable to the Dependents of Homeguard Jawan who died in harness and also pay one time grant of Rs. 1,50,000 payable to those Homeguard who completed twenty years of service.
(ii) For issuance of an appropriate writ including writ in the nature of Mandamus
Patna High Court CWJC No.16078 of 2022(2) dt.21-06-2023 2/3 commanding and directing the respondents to nominate as a Homeguard to the dependent legal heirs of deceased Homeguard who died in harness.
(iii) For issuance of appropriate writ including a writ in the nature of mandamus commanding and directing the respondents to pay all the medical expenses incurred during treatment of Homeguards died in harness on duty.
(iv) For issuance of an appropriate writ including a writ in the nature of writ of mandamus commanding and directing the respondents to pay all the dues with interest from the time they become due till the actual payment of the dues."
At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the competent authorities for redressal of her aforesaid grievances. Liberty so sought, is granted.
It is needless to state that in case, appropriate petition is filed within a period of four weeks from today, before the competent authority, especially for payment of the amount of medical expenses incurred in the treatment of the deceased, the same shall be considered in accordance with law and a reasoned and a speaking order shall be passed within a period of
Patna High Court CWJC No.16078 of 2022(2) dt.21-06-2023 3/3 six weeks, thereafter.
The writ petition stands disposed off on the aforesaid terms.
