The petitioners have renewed their prayer for grant of regular bail in a case registered under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 909 litres of IMFL was recovered from the vehicle being driven by the petitioner no.1 and in which the petitioner no. 2 was also present. It is submitted by learned counsel for the petitioners that the earlier application for bail of the petitioners was rejected vide order dated 16.5.2022 (Annexure-1) passed in Cr. Misc. no. 66457 of 2021 giving liberty to the petitioners to renew their

Patna High Court CR. MISC. No. 59894 of 2022(2) dt.23-11-2022 2/2 prayer for bail on completing one year in custody. The petitioners are in custody since 27.9.2021 and have no criminal antecedent.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the liberty granted by the aforesaid order dated 16.5.2022 together with the petitioners having remained in custody for over 1 year, both the petitioners are directed to be enlarged on bail in connection with Araria P.S. case no. 852 of 2021 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II- cum -Special Judge Excise, Araria.
