2. The petitioner seeks pre-arrest bail in connection with Ghanshyampur P.S. Case No. 81 of 2022 dated 06.04.2022 registered for the offence(s) punishable under Sections 147, 148, 149, 341, 323, 324, 307, 387 and 504 of the Indian Penal Code.

3. As per the allegation made in the FIR, specially against the petitioner is that he had snatched a golden chain from the informant. Thirteen persons including the petitioner and five unknown persons have been named in the FIR.

4. Learned counsel appearing on behalf of the petitioner submitted that there is a previous enmity between the

Patna High Court CR. MISC. No.64004 of 2023(2) dt.17-10-2023 2/3 informant and petitioner and final form has also been submitted in favour of the petitioner on 03.09.2022. It is further informed that petitioner's criminal history has been narrated in paragraph No. 3 in which it has been stated that petitioner is involved in 12 cases, out of which in three cases, he has been acquitted and eight cases, in which petitioner is on bail, has been lodged by the informant of the present case and his family members.

5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.

6. Considering the nature of allegation made against the petitioner in the FIR and also the fact that final form has been submitted in favour of the petitioner, I am of the opinion that petitioner has, prima facie, made out a case to be released on pre-arrest bail.

7. The petitioner, above named, is directed to be released on pre-arrest bail, in the event of his arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Biraul, Darbhanga in connection with Ghanshyampur P.S. Case No. 81 of 2022, subject to the conditions as laid down under Section
