JUSTICE ARUN KUMAR ORAL ORDER 29-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Aurai PS Case No. 3 of 2016 registered under Section 395 of the IPC and Section 27 of the Arms Act.

Learned Counsel for the petitioner submits the FIR is against unknown and except disclosure of name of the petitioner in the confessional statement of Jalandhar Rai regarding his participation, there is no other material, even he was not put on TIP and there is no recovery of any incriminating article. Charge-sheet has been submitted in this case and besides this the petitioner has no other criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Md. Ladale is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Muzaffarpur in connection with Aurai PS Case No. 3 of 2016.
