JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This is an application for grant of anticipatory bail in connection with Munger Muffasil P. S. Case No. 128 of 2019, disclosing offences under Sections 448, 341, 323, 324, 452, 380, 354, 34 of IPC.

As per F.I.R. there is allegation against this petitioner is of assault by butt portion of the pistol to the informant and against other co-accused persons there is allegation of snatching the golden chain and taking away Rs.10,000/-. Submission of the learned counsel for the petitioner is that in this case only allegation against the petitioner is of assault by butt portion of the pistol to the informant, that shows the intention of the petitioner and if he wants to kill the informant, he would have fired from the pistol and a complaint also lodged by the informant against the accused persons.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Munger, in connection with Munger Muffasil P. S. Case No. 128 of 2019, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
