JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-06-2022 The present writ petition has been filed for directing the respondent-State authorities to take steps for removing the encroachment made by the private respondent no. 6 on the public land/road in front of the house of the petitioner. This Court finds that appropriate remedy for the petitioner is to approach the Circle Officer, Kotwa, East Champaran under the provisions of the Bihar Public Land Encroachment Act, 1956.
The learned State counsel also does not have any objection if the petitioner approaches the Circle Officer
Patna High Court CWJC No.95 of 2019(2) dt.23-06-2022 2/2 concerned for necessary action and he submits that appropriate action shall be taken in accordance with law expeditiously. Accordingly, the present petition stands disposed off as not pressed, however, with liberty to the petitioner to approach the Circle Officer, Kowta, East Champaran by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956 and in case such a petition is filed within a period of four weeks from today, the Circle Officer concerned shall issue notice to the concerned affected parties and take appropriate action in accordance with law within a period of eight weeks thereafter.
