The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504 and 506/34 of the Indian Penal Code. It is a case of assault and open firing upon the informant but no one was hit.

It is submitted by learned counsel for the petitioners that the petitioners have falsely been implicated in this case. He further submits that there is case and counter case between the parties and both parties have sustained injuries as alleged in separate incident. He further submits that good sense has

Patna High Court CR. MISC. No.71603 of 2021(2) dt.20-07-2022 2/2 prevailed between the parties vide Annexure-4 to the present petition. He also submits that these petitioners were not sent up for trial but cognizance has been taken against them. Petitioners have got clean antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Madhepura in connection with Kumarkhand P.S. Case No. 01 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
