The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.

As per FIR, the allegation against the accused persons including the petitioners is of abusing and assaulting the informant and her family members, as a result of which son of the informant namely, Ajay Mandal sustained injury. It is submitted by learned counsel for the petitioners that the petitioners are innocent and have committed no offence.

There is case and counter case between both the parties. As per F.I.R., co-accused Anuj Mandal had hit Ajay Mandal with iron pipe causing head injury and thereafter petitioner no. 1 had hit by lathi. The allegation on petitioner no. 2 is that he had assaulted Kamlesh Mmandal and not Ajay Mandal and there was no any injury report of Kamlesh Mandal. So far injuries are concern, non contrast C.T. Scan of injured Ajay Mandal was conducted and as per Radiology Report, a hairline fracture on the left high parietal bone and fracture on the right temporal parietal bone has been reported. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. It is also submitted that petitioners are languishing in judicial custody since 29.05.2023.

Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Sadar (Sonki O.P.) P.S.
