JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 14-01-2015 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner, apprehending his arrest in connection with Belhar P.S. Case No. 53 of 2014 registered for the offences punishable under Section 366A of the Indian Penal Code, seeks the privilege of pre-arrest bail.

Allegedly, the petitioner has kidnapped the minor daughter of the informant from his lawful guardianship with intent to get her marriage solemnized with other person. During investigation, the victim girl has been recovered and she has given her statement under Section 164 Cr.P.C. wherein she has stated that she was not kidnapped by the other. She has come to her mother and is residing with her mother and her uncle claiming as

In view of the statement of victim girl recorded under Section 164 Cr.P.C. that she was not kidnapped, the petitioner in case of his arrest or surrender within two months from the date of receipt/production of the copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class , Banka, in connection with Belhar P.S. Case No.53 of 2014, subject to the conditions as laid down under Section 438(2) Cr. P.C.
