Prayer is for bail in Bind P.S. Case No. 29 of 2017 registered under Sections 304B/201/34 of the Indian Penal Code.

It is submitted that the petitioner is the father-in-law and is in custody since 31.08.2017. Considering the peculiarity of the case, the mother-in-law, being the wife of the petitioner, has been granted anticipatory bail vide order at Annexure-3. Learned counsel submits that the prime responsibility is of the husband who is already in custody. It is also submitted that the petitioner normally resides outside the State in connection with the livelihood. He relies in this regard on Annexure-2. Let the petitioner be released on bail on furnishing bail

Patna High Court Cr.Misc. No.53006 of 2017(2) dt.20-11-2017 2/2 bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Nalanda, (Biharsharif) in Bind P.S. Case No. 29 of 2017 subject to the condition that one of the bailors shall be own/close family member of the petitioner with further condition that with further condition that as soon as charges are framed, the petitioner shall appear in person on each and every date fixed in the trial. In case of default on two consecutive occasions without any cogent/satisfactory reason, the bail bond of the petitioner shall be cancelled and thereafter the Trial Court will be at liberty to secure his arrest in accordance with law.
