JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The alleged occurrence took place in the year, 2005 whereas; petitioner was remanded in this case on 17-04-2015 on the basis that in course of investigation, one co-accused, Kapil Kahar confessed his guilt, disclosing the name of the petitioner. Submission on behalf of the petitioner is that petitioner was sent to jail in connection with other cases in the year, 2006 and since then, he was languishing in jail custody but in spite of that, police remanded him in the present case on 17-04-2015. It is further submitted by him that except the aforesaid confessional statement as well as criminal antecedent of the petitioner, there appears to be nothing against him in the present case.
Patna High Court Cr.Misc. No.5251 of 2016 (2) dt.12-02-2016 2/2 No doubt, petitioner does carry criminal antecedent of several cases but in the present case, except confessional statement, there is nothing against him.
Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Chenari P.S. Case No. 21 of 2005 to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram.
