2. In this case, the petitioner is seeking regular bail in connection with G.R. No. 397 of 2024 arising out of Kutumba P.S. Case No. 128 of 2024, registered for the offences punishable under Section 30(a) of the Bihar Prohibition of Excise Amendment Act 2022.

3. As per allegation, 50 litres of country-made liquor was recovered from the motorcycle of the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Nothing has been recovered from the conscious possession of the petitioner. He is a person of clean antecedent. He is under custody since 29.07.2024.

5. On the other hand, learned APP for the State has opposed the prayer for bail of the petitioner.

6. Considering the above-mentioned facts and circumstances, the petitioner, above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned court of Special Judge of Excise-1, Aurangabad in connection with G.R. No. 397 of 2024 arising out of Kutumba P.S. Case No. 128 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
