The petitioner is apprehending his arrest in a complaint case wherein cognizance has been taken under Section 420 of the Indian Penal Code and Section 138 of the Negotiable Instruments Act.

It is alleged that complainant gave rupees six lakhs to the petitioner on her assurance to get 10 dhurs of land registered in her favour but after several reminders she did not get her land registered in favour

Patna High Court CR. MISC. No.1476 of 2022(2) dt.15-06-2022 2/3 of the complainant and when the complainant demanded her money back, a cheque of rupees six lacks was issued which got dishonored.

A supplementary affidavit has been filed on behalf of the petitioner to the effect that petitioner is ready to pay Rs. 3,00,000/- to the complainant. The petitioner is ready to pay Rs. 50,000/- at the time of furnishing bail bonds and the rest amount of Rs. 2,50,000/- will be paid by the petitioner in installment of Rs. 25,000/- in every three months till the completion of Rs. 3,00,000/-.

Mr. Birendra Kumar, learned counsel appearing on behalf of the complainant has accepted the offer of the petitioner.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands)

Patna High Court CR. MISC. No.1476 of 2022(2) dt.15-06-2022 3/3 with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Complaint Case No. 5137 (C ) of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The aforesaid payment will be subject to final adjudication of the case.
