The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 392, 394 of the Indian Penal Code.

As per prosecution case, the informant being Field Worker of ESAF Small Finance Bank, was coming back his office after collecting money from Korra village, in the meantime, three miscreants riding on a bike obstructed the informant and committed robbery. During commission of robbery, they took away Rs. 29,885/-, a lenevo tab and two mobiles phones from the informant

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this present case on the basis of suspicion. Neither the petitioner named in FIR nor any incriminating article has been recovered from his conscious or constructive possessions. The name of the petitioner came into light on the basis of confessional statement of co-accused Jubrail Ansari, who is already getting the privilege of bail granted by a coordinate Bench of this Court vide order dated 30.9.2022 in Cr. Misc. No.37905 of 2022. It is further submitted that the petitioner is languishing in judicial custody since 08.07.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The

Patna High Court CR. MISC. No.72038 of 2022(3) dt.22-05-2023 3/3 above named petitioner is directed to be released on bail in connection with Banka P.S. Case No. 286 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka.
