2. The petitioner has preferred this application for grant of regular bail in connection with Jaynagar P.S. Case No. 69/2023 registered under sections 272, 273, 414 and 34 of the Indian Penal Code.
3. As per prosecution case, 90 litres of Nepali wine each was recovered from the three named accused persons including the petitioner herein and also two other co-accused namely Abhishek Kumar and Anil Kumar.
4. Learned counsel for the petitioner submits that no incriminating article has been recovered from the petitioner's possession. He has falsely been implicated in this case due to his criminal antecedents and two other co-accused persons namely Abhishek Kumar and Anil Kumar have been enlarged on bail
Patna High Court CR. MISC. No.64095 of 2023(2) dt.11-10-2023 2/2 vide order dated 18.05.2023 passed in Cr. Miscellaneous No. 24733 of 2023. The petitioner is in custody since 22.02.2023 and charge-sheet has been submitted in this case.
5. The prayer of the bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegation in the F.I.R., the grant of bail to the two co-accused persons vide order dated 18.05.2023 and charge-sheet having been submitted in this case, the petitioner is directed to be enlarged on bail in connection with Jaynagar P.S. Case No. 69/2023, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J. II cum Special Judge, Excise Act, District- Madhubani. (Partha Sarthy, J) Ranjeet/- U T
