JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-11-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was on bail but it would appear from perusal of the impugned order dated 31.08.2017 that on 06.08.2012, the attendance of one prosecution witness was filed but due to absence of petitioner the aforesaid witness could not be examined and, subsequently, the bail bond of the petitioner was cancelled. However, petitioner could be remanded in this case on 10.08.2017 i.e. after five years of cancellation of bail of the petitioner.

Considering the aforesaid facts and circumstances as well as submission of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with

Patna High Court Cr.Misc. No.53395 of 2017 (2) dt.15-11-2017 2/2 Jadia P.S.Case No. 67 of 2011, pending in the court of learned Judicial Magistrate, Supaul stands rejected. However, petitioner may renew his prayer for bail, if his trail is not concluded within six months from today.
