Mr.Ashok Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 09-11-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. The petitioners are apprehending their arrest in a case in connection with Sonepur P.S. Case No. 222 of 2023 dated 26.03.2023 registered for the offences punishable u/ss 147, 148, 149, 448, 341 323, 307, 354B, 379, 504 and 506 of the Indian Penal Code and u/s 27 of the Arms Act.
3. As per the prosecution case, when the informant was sitting at the door of her house then the petitioners and the
Patna High Court CR. MISC. No.72375 of 2023(2) dt.09-11-2023 2/3 co-accused persons came there. The petitioner no. 1 and the coaccused Chandan Singh fired from their pistol. The petitioner no. 3 assaulted the husband of the informant with iron rod as a result of which he became injured and fell down. The petitioner no. 4 and the co-accused Subodh Kumar outraged the modesty of the informant. The petitioners and the co-accused persons abused the daughter-in-law of the informant and also assaulted her. It is further alleged that the two other accused persons took one box from the house of the informant in which jewellery, clothes and cash were kept.
4. Learned counsel for the petitioners has submitted that the petitioners have falsely been implicated in this case. There is general and omnibus allegation against the petitioners. It is further submitted that the petitioners have no concern with the alleged offence. There is a case and counter case between the parties. The petitioners have two criminal antecedent as stated in para 3 of the bail petition.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be

No.72375 of 2023(2) dt.09-11-2023 3/3 enlarged on bail on furnishing bail-bond of Rs. 20,000/- (Rupees Twenty thousand) each with two sureties of the like amount each to the satisfaction of learned court concerned, Chhapra, Saran in connection with Sonepur P.S. Case No. 222 of 2023, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
