The petitioner seeks bail in connection with Sherghati P.S. Case no. 93 of 2017 registered for the offence punishable under Sections 420, 467, 468 and 471 of the Indian Penal Code.

The petitioner along with other accused persons are said to have taken Rs. 64,000/- each from the informant and others in the name of managing job for them in South Africa and Kuwait and also sent forged Visa and other documents through email to them.

It is submitted by the learned counsel for the petitioner that the petitioner has not taken any money from the informant and others. There is no evidence of giving money to

Patna High Court Cr.Misc. No.53747 of 2017 (2) dt.09-11-2017 2/2 the petitioner by them. Regarding the same occurrence, the informant had lodged Amas P.S. Case no. 38 of 2017 and in that case, the petitioner has been enlarged on bail by a coordinate Bench of this Court vide order dated 17.10.2017 passed in Cr. Misc. no. 48856 of 2017. The allegation levelled against the petitioner is not specific rather omnibus. The petitioner has been languishing in custody since 24.07.2017. Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Sherghati P.S. Case no. 93 of 2017.
