Mr. Mohit Shrivastava, learned counsel for the petitioner submits that this is the second anticipatory bail application filed on behalf of the petitioner in connection with Bihar P.S.Case No. 496 of 2018 registered under Section 30 and 30(a) of the Bihar Prohibition and Excise Act. He submits that another counsel did not place the fact properly and accordingly, this Court was pleased to dismiss the earlier application filed by the petitioner for anticipatory bail vide order dated 31.07.2019 as withdrawn. Learned counsel pressed this application on merit and submits that all the facts were not placed before this Court by the earlier counsel.

Having regard to the submission made by learned counsel

Patna High Court CR. MISC. No.59700 of 2019(2) dt.26-09-2019 2/2 for the petitioner, I do not find any reason to grant anticipatory bail to the petitioner in the present matter and the same is dismissed accordingly.
