Petitioner has prayed for quashing of the FIR of Bodh Gaya (Town) PS Case No. 396/2015. From the Xerox copy of the order-sheet transmitted by the learned lower court in compliance of the order dated 18.09.2018, it is evident that police after concluding investigation, submitted charge-sheet and vide order dated 04.11.2015, cognizance under Section 419, 420, 129/34 IPC has already been taken and petitioner along with Vikash Kumar, have been summoned to face the trial. That being so, instant petition has become infructuous and is, accordingly, dismissed.
