2. The petitioner has prayed for bail in a case registered for the offence punishable under Section 21(b) o fthe N.D.P.S. Act.

3. The case of the prosecution is that altogether 18 gm of brown sugar and 60 tablets of Nitrazepam was recovered from the possession of the petitioner.

4. Learned counsel appearing on behalf of the petitioner has submitted that the contraband which has been recovered from the possession of the petitioner is of small quantity. In this regard State has also filed their counter affidavit and from perusal of the counter affidavit also it transpires that the contraband substance comes under small quantity. The

Patna High Court CR. MISC. No.65004 of 2024(5) dt.28-01-2025 2/2 petitioner is a man of clean antecedent. He is in custody since 19.03.2024.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court of District and Sessions Judge-cum-Special Judge, N.D.P.S. Act, Araria in connection with Special Case No.76 of 2024 arising out of Narpatganj P.S. Case No. 167 of 2024.

7. Accordingly, the present bail application stands allowed.
