JUSTICE SANJAY PRIYA ORAL JUDGMENT Date : 18-09-2018 Heard learned counsel for he petitioner and the State. This petition under Section 482 Cr.P.C. has been filed for quashing the order dated 31.10.2015 passed by the S.D.J.M., Patna City in Chowk P.S. case no. 05 of 2013 by which learned Magistrate has taken cognizance for the offence under Sections 420 and 409/34 of the IPC and Section 7 of the E.C. Act against the petitioner and others.

Learned counsel for the petitioner has submitted that petitioner has died in Heart Hospital Patna no. 10.9.2018 at 5.30PM. The Xerox copy of the death certificate issued from the Hospital has been filed today in the Court In such circumstances, this court is not inclined to pass any order on merit in this petition.

Accordingly, this Cr. Misc. petition is disposed off with

Patna High Court Cr.Misc. No.3502 of 2016 dt.18-09-2018 2/2 direction to the counsel for the petitioner to file necessary petition before the court below with proof of death of the petitioner and in that event the Court below will pass appropriate order in accordance with law.
