The application has been filed for a direction upon the respondent to sanction family pension to the petitioner as her husband was a victim of notorious Bhagalpur Blinding Case. The said claim was rested on averments made in paragraph 4 that other victims had been granted the family pension.

Vide order dated 18.12.2012, the petitioner was directed to furnish the names. On 30.12.2012, this Court passed the following order:- "In spite of indulgence granted on 11.10.2012, 12.10.2012, 18.10.2012 counsel for the petitioner has not been able to refute the submissions made in the counter affidavit that dependents of other victims of Bhagalpur Blinding Case are not getting pension. Let the matter be placed in Admission-III list maintaining its position as per the date of filing so as to enable the counsel for the petitioner to get another

Patna High Court CWJC No.19255 of 2012 (6) dt.22-12-2015 2/2 indulgence for filing the rejoinder affidavit." The petitioner has not furnished any detail.

On the contrary, the respondent State in the counter affidavit has stated about rejecting of her claim for grant of family pension. The relief was claimed on parity. The petitioner has not, in spite of indulgence, brought on record any case where the dependent of the victims of the blinding case was sanctioned family pension.

Considering the materials on record, no relief can be granted to the petitioner.

The writ application is dismissed.
