JUSTICE MADHURESH PRASAD ORAL ORDER 19-12-2017 Heard learned counsel for the petitioner and learned APP for the State.

This is a case registered under Sections 147,148,149,341,323,307,386 and 504 of the Indian Penal Code. It is submitted on behalf of the petitioner that merely because he was related to one Sonu Kumar and Victoria Sao, he has been implicated in this case as a counter blast to Makhdumpur (Tehta) P.S. Case No. 96 of 2017. He submits that there is no injury report on the record of the case so as to sustain allegation attributed to the petitioner regarding firing. The other co-accused namely, Vicky Kumar has been granted bail vide order dated 11.09.2017 in Cr. Misc. No. 34447 of 2017. The petitioner is in jail custody since 22.08.2017.

In the facts and circumstances of the case, prayer for

Patna High Court Cr.Misc. No.60195 of 2017 (2) dt.19-12-2017 2/2 bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Jehanabad in Makhdumpur (Tehta O.P) P.S. Case No. 103 of 2017 subject to the conditions :

(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.

(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
