Learned counsel for the petitioner submits that on account of petitioner's criminal antecedents, he has been made accused in the instant case. He was not present at the place of occurrence from where the motorcycle was recovered. 2.

Realising the difficulty on account of Section 76(2) of the Bihar Prohibition and Excise Act, he submits that he would be raising this issue for consideration before the Court while surrendering for grant of bail.

Having regard to the above submissions, the Court would permit the learned counsel for the petitioner to withdraw this application to avail his remedy for grant of regular bail at the time of his surrender relying upon the said submission,
