The petitioner seeks bail in connection with Patory P.S. Case no. 236 of 2017 for the offence punishable under Sections 342, 376, 120-B/34 of the Indian Penal Code and Section 4 of the POCSO Act.

The petitioner along with other accused persons is said to have kidnapped the informant on the pretext of accident of her younger sister and committed rape against her and also took the lewd photograph of the informant and posted the same on whatsapp of her would be bridegroom, resultantly, her marriage was broken.

It is submitted by the learned counsel for the petitioner that the victim is aged about 18-19 years old as

Patna High Court Cr.Misc. No.53771 of 2017 (2) dt.10-11-2017 assessed by medical board. There is inordinate delay of around five months in lodging the FIR. The charge-sheet in the case has already been submitted.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail. Accordingly, the prayer is rejected.

However, the learned trial court is directed to conclude the trial as expeditiously as possible preferably within six months from the date of receipt/production of a copy of this order.
